These Terms of Service ("Terms") govern your access to and use of the Quick Qualify platform and services. Please read them carefully. By creating an account or using the Service, you agree to be bound by these Terms.
"Quick Qualify," "we," "us," or "our" refers to Quick Qualify, the operator of the quickqualify.net platform. "Service" means the Quick Qualify AI lead qualification software and all related features, APIs, and integrations. "Customer," "you," or "your" refers to the individual or legal entity that has agreed to these Terms. "Subscription" means a paid plan granting access to the Service for a recurring billing period.
You must be at least 18 years old and have the legal authority to enter into a binding contract to use the Service. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
To access the Service, you must register for an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at hello@quickqualify.net if you become aware of any unauthorised use of your account.
Quick Qualify offers paid Subscription plans as described on our Pricing page. By selecting a Subscription, you authorise us (through our payment processor, Paddle) to charge your payment method on a recurring basis at the start of each billing period.
We may offer a free trial period for new customers. No credit card is required during the trial. At the end of the trial, access to paid features will require a Subscription. We reserve the right to modify or discontinue free trial offers at any time.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of all lead data and contact information you input into the Service. You grant Quick Qualify a limited licence to process that data solely for the purpose of providing the Service to you. We do not use your data to train AI models, and we do not sell your data to third parties.
The Service, including all software, algorithms, designs, and content created by Quick Qualify, is our exclusive property and is protected by copyright, trade secret, and other intellectual property laws. These Terms do not grant you any ownership rights in the Service. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
The Service may integrate with third-party platforms such as HubSpot, Salesforce, and others. Your use of those platforms is governed by their respective terms and privacy policies. We are not responsible for the conduct of any third-party service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY QUALIFICATION SCORES WILL BE ACCURATE OR COMPLETE. LEAD QUALIFICATION RESULTS ARE GENERATED BY AN AI MODEL AND SHOULD BE USED AS A TOOL TO ASSIST DECISION-MAKING, NOT AS A SUBSTITUTE FOR PROFESSIONAL JUDGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUICK QUALIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Quick Qualify and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if required by law. You may terminate your account at any time by contacting us at hello@quickqualify.net. Upon termination, your right to use the Service will immediately cease. Sections 7, 8, 10, 11, 12, and 15 will survive termination.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where changes are material, notify you by email or via an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with applicable law. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or the courts of competent jurisdiction, as required by applicable law in your location.
